City Records and Open Records Requests
The Georgia Open Records Act, establishes the right of every citizen to inspect and take a copy of all records except those specifically exempt from being open. When an agency receives a record request under the Open Records Act, it must comply with guidelines established in the law:
• The agency has three business days from the date of the request to determine if the requested records, or portions of such records, are open or closed.
• If the records are closed, the agency must respond in writing specifying the legal authority for restricting access to the records.
• Otherwise, the records are to be provided within the three-day period or a plan for providing access to the records provided to the requester.
The Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq) requires that all city records, except those excluded by court order or by law, be open for personal inspection by any citizen of Georgia in a reasonable time and place. However, no public officer or agency shall be required to prepare reports, summaries, or compilations not in existence at the time of the request. Please review the Georgia Open Records Act for additional information.
Additionally, the Office of the City Clerk is responsible for the following items:
An Open Records Request should be made directly to the City of Mableton's records custodian of the records.
Under the Georgia Open Records Act, all public records are available for inspection and copying unless they are specifically exempted from disclosure under the law. If a government agency or custodian of public records withholds a public document from production under an Open Records Request, they must cite to the specific statutory provision of Georgia law that exempts the record from being produced.
A request to inspect or copy records may be made either orally or in writing. For purposes of documenting and clarifying the scope and timing of the request, it is a better practice to make the request in writing, and actions to enforce the ORA can only be based on written requests.
